Commento dell’articolo 5 della Dichiarazione Universale dei Diritti Umani

COMMENT OF THE 5 ARTICLE OF THE UNIVERSAL DECLARATION OF HUMAN RIGHTS
Article 5 of the Universal Declaration of Human Rights:

"No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment."

Article 5 of the Universal Declaration of Human Rights emphasizes the fundamental right to be free from torture or any form of cruel, inhuman, or degrading treatment or punishment. This article recognizes the inherent dignity and worth of every individual and asserts that no one should be subjected to such acts.

Torture and cruel treatment not only inflict severe physical and psychological pain on individuals but also violate their basic human rights. This article affirms the absolute prohibition of torture and serves as a strong statement against any form of abusive or degrading treatment. It reflects the recognition that every person deserves to be treated with respect and dignity, regardless of their circumstances or actions.

Furthermore, this article highlights the universal nature of the right to be free from torture. It applies to all individuals, without any discrimination or exception. It places a responsibility on governments and authorities to ensure that effective measures are in place to prevent torture and punish those responsible for such acts.

The prohibition of torture is a non-derogable right, meaning that it cannot be suspended or limited under any circumstances, even in times of war, emergency, or threat to national security. This underscores the absolute and inherent nature of the right to be free from torture.

Unfortunately, despite the clear condemnation of torture in international law, it continues to be practiced in various parts of the world. Efforts to eradicate torture and cruel treatment require the commitment of governments, institutions, and individuals to enforce laws, establish safeguards, and promote awareness and accountability.

In conclusion, Article 5 of the Universal Declaration of Human Rights enshrines the principle that no one should be subjected to torture or any form of cruel, inhuman, or degrading treatment. It stands as a fundamental safeguard against the abuse of human dignity and serves as a reminder of the ongoing need to protect and promote human rights for all individuals.
